Terms & Conditions — Launceston Catering Company
These Terms & Conditions apply to all orders placed with Launceston Catering Company (“we”, “our”, “us”) via our website, online ordering platform, email, or any other ordering method. By placing an order, you agree to these Terms & Conditions.
1. Orders
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel an order at our discretion, including where products, ingredients, staffing, or delivery capacity are unavailable.
Orders placed through our online ordering platform are considered confirmed once payment has been successfully processed and a confirmation email has been issued.
It is the customer’s responsibility to ensure all order details, including delivery date, time, location and contact details, are correct at the time of ordering.
2. Cut-Off Times
Orders must be placed before the ordering cut-off time shown on our website. Orders received after the cut-off may not be accepted or may incur additional fees.
We do not guarantee the availability of menu items for late or last-minute orders.
3. Payments
Payment is required at the time of ordering unless a prior written account agreement has been approved by us.
We accept payment via the online platform and any other methods specified on our website. Prices are listed in Australian Dollars (AUD) and include GST unless otherwise stated.
We reserve the right to suspend or cancel future orders where payment has failed or remains outstanding.
4. Delivery
Delivery times are estimates only. While we make every effort to deliver within the nominated delivery window, we are not liable for delays caused by circumstances outside our control, including traffic, accidents, weather, road closures, building access restrictions or incorrect delivery information.
Customers must ensure:
• a contact person is available to receive the order
• clear and safe access is available
• correct delivery details and instructions are provided
If delivery cannot be completed due to incorrect details or no one being available to receive the order, the order will be deemed delivered and no refund will be provided.
Additional charges may apply for difficult access, stairs, long walking distances, or parking restrictions.
5. Changes and Cancellations
Changes or cancellations must be made before the published order cut-off time.
After the cut-off time, orders are committed to purchasing, preparation and staffing and therefore:
• Cancellations after cut-off are non-refundable
• Reductions in quantity after cut-off cannot be accepted
• Date changes are treated as cancellations
We may cancel an order due to unforeseen operational circumstances. In this case a full refund will be provided.
6. Dietary Requirements & Allergies
We take care in preparing food; however, all food is produced in a kitchen that handles allergens including but not limited to gluten, dairy, nuts, eggs, sesame, soy and seafood.
We cannot guarantee the absence of allergens or traces of allergens.
Customers must advise dietary requirements at the time of ordering. We are not responsible for undeclared allergies.
Customers acknowledge that consumption of our food is at their own risk where a severe allergy exists.
Nothing in this clause excludes rights under the Australian Consumer Law.
7. Food Safety & Storage
Risk in the goods passes to the customer upon delivery.
Food must be:
• refrigerated promptly where required
• consumed within 4 hours of delivery if left unrefrigerated
• stored below 5°C if kept for later consumption
We are not liable for food quality or safety where food has been stored, handled, transported or served incorrectly after delivery.
8. Hire Items & Packaging
All platters, equipment or reusable items remain our property unless stated otherwise.
Customers are responsible for loss or damage to hire items from the time of delivery until collection. Replacement costs may be charged.
Disposable packaging is not intended for reheating unless expressly stated.
9. Accounts
Where a business account has been approved:
• Payment terms are 7 days from invoice date unless otherwise agreed in writing
• Late payments may incur administration fees
• We may suspend service on overdue accounts
10. Refunds & Consumer Guarantees
We comply with the Australian Consumer Law.
If a product is not of acceptable quality, not as described, or unfit for purpose, customers are entitled to a remedy as required by law. We may offer a replacement, credit, or refund depending on the circumstances.
We are not required to provide refunds for:
• change of mind
• incorrect orders placed by the customer
• late cancellations outside the allowed period
11. Limitation of Liability
To the extent permitted by law, our liability is limited to:
• replacement of the goods, or
• refund of the purchase price.
We are not liable for indirect or consequential loss including business interruption, lost profits, event delays, or third-party costs.
12. Website Use
Users must not:
• misuse the website
• attempt to gain unauthorised access
• interfere with ordering systems
• use the website for unlawful purposes
We may suspend or block access to users who breach these conditions.
13. Privacy
We collect and store personal information only for the purpose of processing orders, delivery, and customer communication. We do not sell customer data. Further details are contained in our Privacy Policy.
14. Force Majeure
We are not liable for failure to perform obligations where performance is prevented by events beyond our reasonable control, including natural disasters, power outages, supplier failure, labour shortages, or government restrictions.
15. Governing Law
These Terms & Conditions are governed by the laws of Tasmania, Australia. Any disputes will be subject to the jurisdiction of Tasmanian courts.
16. Changes to Terms
We may update these Terms & Conditions at any time. The current version published on our website applies to all orders.
